Terms of Service

1. What ARTCURRATO is

ARTCURRATO ("we", "us") operates a marketplace venue at artcurrato.ai where independent art galleries ("Galleries") offer original artworks for sale to buyers ("Collectors"). ARTCURRATO is a venue, not a seller. Every purchase is a transaction between the Collector and the Gallery.

2. Galleries are the sellers of record

Each Gallery, not ARTCURRATO, is responsible for:

• the authenticity, provenance, condition, and description of every artwork it lists;
• packing, insuring, and shipping sold works;
• collecting and remitting all applicable taxes on its sales (including via Stripe Tax on its own Stripe account);
• refunds, returns, chargebacks, and payment disputes;
• confirming each order within 24 hours of purchase. Orders not confirmed within 24 hours are subject to automatic refund in full.

3. Payments

Payments are processed by Stripe on the Gallery's own Stripe account. The Gallery is the merchant of record. ARTCURRATO charges the Gallery a platform fee of 3% of the artwork price per completed sale, plus Stripe's standard processing fees, collected automatically at the time of sale. Collectors pay no fee to ARTCURRATO.

4. Gallery image license

Galleries warrant that they hold all rights necessary to the images and text they submit, and grant ARTCURRATO a non-exclusive, royalty-free license to display, reformat, enrich, and distribute that content (including in machine-readable form) for the purpose of operating and promoting the marketplace.

5. One-of-a-kind holds

When a Collector begins checkout, the artwork is reserved for up to 30 minutes. If checkout is not completed, the reservation lapses automatically. Listing availability is updated in good faith but is not a guarantee; if a Gallery has sold a work offline before your purchase completes, your sole remedy is a full refund.

6. Acceptable use

No misrepresentation of works, no manipulation of prices or reviews, no use of the marketplace for money laundering or sanctions evasion. We may remove listings or Galleries at our sole discretion.

7. Disclaimers & liability

The marketplace is provided "as is." To the fullest extent permitted by law, ARTCURRATO disclaims all warranties and limits its aggregate liability to the fees it received on the transaction giving rise to the claim. ARTCURRATO makes no representation about the investment value of any artwork.
